The kiss “was not consented and it was a one-sided, surprising initiative,” the judge states in the court document at the end of his investigation.

“The erotic purpose or not, as well as the state of euphoria and excitement that prevailed after the extraordinary sporting triumph, are elements whose consequences and legal consequences must be assessed during the trial,” he believes, while Luis Rubiales mentions it in his defense had his feeling, “a moment of happiness, a great joy in that moment”, denying any “sexual connotation”.

Luis Rubiales is charged with “sexual assault” and “coercion” and is not allowed to approach the player more than 200 meters.

He refused to resign over a “little consensual kiss”, and in a blistering speech five days later attacked alleged “fake feminism” and argued he had sought the player's permission before kissing her.

Under pressure, Rubiales eventually resigned on September 10, saying he had been the victim of a “disproportionate campaign.” He has since been suspended from all football-related activities by FIFA for three years, a decision he will appeal.
