Francisco Javier PD, Civil Guard of the Maritime Service of the Province of Málaga, signed a contract in the summer of 2021 to work as a driver in Marbella for the Saudi royal family during his vacation. The agent had the right to combine his profession with that of a personal driver, but instead of this task he devoted himself to acting as a private escort for the Bin Turky family, accompanying and monitoring them armed on their forays through the city the interior and exterior of your home. The Supreme Court has now confirmed a very serious sanction against the agent, consisting of a three-month and one-day suspension from employment, as it is proven that he acted as an escort for the royal family without authorization.
The Military Chamber's ruling details how the security guard accompanied the Bin Turky family, part of the Saudi royal family, between August 1 and September 17, 2021. He testified in the file submitted to the agent, assuring that the agent, who identified himself as Civil Guard “showed off” that he was the one who “directly” protected the Bin Turky couple and that they never saw him work. He always sat in the passenger seat or in the back, when they exited the vehicle he did not separate from the couple and when they were in the house he observed the perimeter of the villa.
The territorial private security unit of the Malaga National Police Station carried out surveillance work on the family's bodyguards and the protocol it prepared confirmed that the guard was responsible for the family's safety. “The actors observed how the man described always remained close to the two women and maintained a minimum distance behind them at all times, which could be approximately between 3 and 5 meters, so that when he walked, he was also doing it and as they When they stopped, the man also stopped and kept his distance again. “The affected party did not at any time interact with the women and remained completely attentive to their surroundings, so the acting agents had to exercise particular caution to avoid detection given the intense state of surveillance displayed by the above-mentioned individuals.” said he wrote to police about a visit to a mall. As they entered the establishment, police approached the security guard, who identified himself as such, claimed he had a contract as a driver for the Saudi royal family and admitted he was armed with a private pistol.
The report that police sent to the government sub-delegation concluded that when the agent was identified, he was “carrying out private security activities that were made available to individuals on an irregular basis.” This report, together with the testimony of witnesses and employees of the private security company, was crucial in resolving the case opened against Francisco Javier PD. The guard was initially punished with a six-month suspension for a very serious disciplinary offense under Article 7.18 of the Organic Law of the Civil Guard Disciplinary Code of 2007: “Develop any activity that violates the rules on incompatibilities.” The agent appealed and the management The Civil Guard reduced the sanction to three months, which was ratified by Defense Minister Margarita Robles in March 2023. This sanction is the one that the Supreme Court has now confirmed following a fresh appeal.
The agent claimed in the Supreme Court that he had only acted as a driver during his vacation and that his presumption of innocence had been violated. The court rejected this claim and warned of the “abundant amount of evidence” available against the security guard. “A river through which the facts that the sanction decision itself considers to be proven flow easily,” warns the court. On the other hand, with regard to the exculpatory evidence presented by Francisco Javier PD, the Supreme Court concludes that “they do not prove that the facts declared private do not correspond to reality”.
Together with this agent, another colleague was punished who, on the same dates, worked for the Saudi royal family as a “companion,” “assisting them in their purchases and providing them with security in their movements,” and whom he had no authorization to carry out his activity in the Guardia Civil with another job. During the processing of the disciplinary file, this guard admitted the matter and accepted the sanction.
